Terms of Service

Effective Date: January 17, 2026
Last Updated: August 30, 2026

1. Introduction

Welcome to Between Living (“Between Living,” “Company,” “we,” “our,” or “us”).

These Terms of Service (“Terms”) govern your access to and use of betweenliving.com and its associated webpages, ecommerce functionality, content, products, and related services (collectively, the “Services”).

By accessing the Website or placing an order through Between Living, you agree to be bound by these Terms together with the policies and product-specific terms applicable to your use or purchase.

These Terms should be read together with our applicable:

  • Shipping Policy
  • Return & Refund Policy
  • Cancellation Policy
  • Billing Terms & Conditions
  • Privacy Policy
  • Cookie Policy
  • Disclaimer Policy
  • Product-specific terms
  • Manufacturer-specific terms
  • Warranty information where applicable

If you do not agree to these Terms, you should not use the Services or place an order.

Nothing in these Terms is intended to waive, restrict, or exclude rights that cannot lawfully be waived, restricted, or excluded.

2. Eligibility

By using the Services or placing an order, you represent that you are at least 18 years of age or otherwise have the legal capacity to enter into a binding agreement under applicable law.

If you use the Services or make a purchase on behalf of a business, organization, or other legal entity, you represent that you have authority to act on behalf of and bind that entity.

3. Customer Accounts

3.1 Account Creation

Certain Website features may allow or require creation of a customer account.

If you create an account, you agree to provide information that is accurate, current, and reasonably complete.

You are responsible for updating account information where necessary.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for taking reasonable steps to prevent unauthorized use of your account.

Please contact Between Living promptly if you become aware of suspected unauthorized access or use.

Between Living may take reasonable measures to protect an account, transaction, or customer where unauthorized activity is suspected.

Nothing in this section limits rights or remedies available regarding unauthorized payment transactions under applicable law or payment-provider rules.

4. Products and Product Information

4.1 Product Availability

Products are subject to availability, manufacturer availability, production capacity, and other fulfillment conditions.

Between Living may:

  • Add or discontinue products
  • Modify product offerings
  • Limit quantities
  • Update configurations or options
  • Correct product information
  • Decline or cancel an order where fulfillment is not reasonably available

Any cancellation by Between Living will be handled in accordance with these Terms and applicable payment or refund requirements.

4.2 Manufacturer Products

Between Living works with multiple manufacturers, distributors, warehouses, and fulfillment partners.

Certain products may be:

  • Made to order
  • Special order
  • Configured to customer selections
  • Manufactured after purchase
  • Fulfilled directly by a manufacturer
  • Delivered by parcel carrier
  • Delivered by freight carrier
  • Subject to product-specific lead times
  • Subject to manufacturer-specific cancellation or return conditions

Where manufacturer-specific or product-specific terms are provided for a purchase, those terms should be reviewed before ordering.

4.3 Product Descriptions and Specifications

Between Living makes reasonable efforts to provide accurate product information.

Product specifications, dimensions, finishes, materials, capacity, electrical requirements, installation information, included components, photography, availability, and other details may originate from manufacturers or authorized product sources and may change.

Manufacturer documentation and specifications applicable to the product actually supplied may control where a discrepancy occurs.

If a particular specification is critical to your purchase or installation, please contact Between Living before ordering.

Further information is provided in our Disclaimer Policy.

5. Pricing

5.1 Currency

Unless expressly stated otherwise, prices displayed on Between Living are in U.S. Dollars (USD).

5.2 Price Changes

Prices, promotions, discounts, and product offerings may change from time to time.

A later price change does not generally alter the price of a valid completed order.

5.3 Pricing and Listing Errors

Between Living makes reasonable efforts to maintain accurate pricing and product information. However, typographical, technical, configuration, promotional, or listing errors may occasionally occur.

If a material error affects an order, we may take reasonable corrective action consistent with applicable law.

Depending on the circumstances, this may include:

  • Contacting you regarding the error
  • Correcting the amount
  • Issuing a refund or credit
  • Requesting authorization for a corrected transaction
  • Cancelling and refunding an affected order where appropriate

We will not knowingly impose an undisclosed higher product price after a completed order without communicating the issue and available resolution.

Billing matters are addressed more fully in our Billing Terms & Conditions.

6. Orders

6.1 Placing an Order

By submitting an order, you represent that the information you provide is accurate and that you are authorized to use the selected payment method.

You are responsible for reviewing:

  • Product selection
  • Size or capacity
  • Configuration
  • Quantity
  • Shipping address
  • Billing information
  • Contact information
  • Applicable product terms

before submitting the order.

6.2 Order Confirmation

An automated order confirmation acknowledges that we have received your order.

An order confirmation does not necessarily mean that all aspects of the order have been finally verified or accepted.

Certain orders may require:

  • Payment authorization
  • Fraud review
  • Product availability confirmation
  • Manufacturer confirmation
  • Delivery-detail confirmation
  • Freight-access confirmation
  • Configuration review
  • Other reasonable verification

before fulfillment.

6.3 Order Acceptance

Between Living reserves the right, to the extent permitted by law, to decline or cancel an order for legitimate reasons including:

  • Product unavailability
  • Manufacturer discontinuation
  • Material pricing or listing error
  • Payment failure
  • Suspected fraud or unauthorized activity
  • Inability to verify information reasonably necessary to process the order
  • Delivery restrictions
  • An unavailable configuration
  • A product or order that cannot reasonably be fulfilled as submitted

If Between Living cancels an order after payment because we cannot fulfill it, any applicable amount paid for the cancelled portion will be refunded appropriately.

7. Payment

7.1 Payment Methods

Between Living accepts the payment methods displayed as available during checkout.

Depending on availability, these may include supported:

  • Credit cards
  • Debit cards
  • Shop Pay
  • Apple Pay
  • Google Pay
  • Other payment methods displayed at checkout

The payment methods actually displayed at checkout at the time of purchase govern the available payment options for that transaction.

7.2 Payment Processing

Payments are processed through Shopify and/or applicable third-party payment providers.

Payment may be subject to authorization, verification, fraud screening, and payment-provider requirements.

7.3 Payment Authorization

By placing an order, you authorize the applicable payment processor to charge the selected payment method for the amounts disclosed in connection with the transaction.

Detailed billing provisions are contained in our Billing Terms & Conditions.

8. Taxes and Additional Charges

Applicable taxes collected by Between Living will generally be calculated and displayed at checkout where reasonably determinable.

Certain charges may arise because of circumstances that cannot reasonably be determined before fulfillment, including, where applicable:

  • Remote-area delivery
  • Customer-requested delivery arrangements
  • Address changes after fulfillment begins
  • Redelivery
  • Storage
  • Failed delivery attempts
  • Special access requirements
  • Manufacturer-authorized changes
  • Freight circumstances
  • Other nonstandard delivery or customer-requested services

Such charges are not arbitrary post-purchase price increases and are governed by the applicable Shipping Policy, product terms, manufacturer terms, or customer-authorized service arrangements.

9. Shipping and Delivery

9.1 Shipping Area

Between Living currently ships within the United States, subject to product, manufacturer, carrier, and destination restrictions.

Please review our Shipping Policy for detailed information regarding processing, production, freight, carriers, delivery, tracking, access requirements, and related matters.

9.2 Processing, Production and Transit

Processing time, manufacturing or production time, and transit time are separate stages.

Certain standard in-stock products may process relatively quickly, while made-to-order, specialty, oversized, configured, or manufacturer-produced products may require substantially longer lead times.

Delivery and lead-time estimates are estimates unless expressly confirmed otherwise.

9.3 Freight Deliveries

Certain products may ship by LTL freight or another specialized delivery method.

Freight orders may involve:

  • Delivery appointments
  • Curbside or end-of-driveway delivery
  • Large trucks
  • Access restrictions
  • Customer unloading responsibilities
  • Delivery inspection
  • Freight documentation
  • Additional manufacturer or carrier requirements

Applicable product and manufacturer delivery instructions should be reviewed before delivery.

9.4 Inspection and Damage

Customers should inspect shipments as reasonably possible upon delivery.

For freight deliveries, visible damage should be documented and noted on applicable delivery or Bill of Lading documentation where appropriate.

Photos, packaging, labels, freight documentation, and damaged materials should be retained where necessary for a claim.

Damage, missing components, or delivery concerns should be reported promptly because carrier and manufacturer claim periods may apply.

9.5 Risk of Loss and Title

We do not impose one universal rule stating that every customer’s risk of loss automatically transfers the moment a product is handed to a carrier.

Risk of loss, title, carrier responsibility, shipment claims, and customer remedies may depend on the applicable transaction, manufacturer terms, carrier terms, delivery arrangement, product-specific terms, and applicable law.

Nothing in these Terms eliminates rights or remedies that may apply in connection with a lost, damaged, or improperly delivered shipment.

Our Shipping Policy governs shipping and delivery procedures in greater detail.

10. Cancellations and Order Changes

Customers should contact Between Living as soon as possible if an order needs to be cancelled or changed.

An order may become:

  • Non-cancellable
  • Non-changeable
  • Subject to a cancellation fee
  • Subject to a change fee

once processing, procurement, customization, manufacturing, production, or other fulfillment activity begins, even if the product has not yet physically shipped.

Made-to-order, configured, specialty, customized, and manufacturer-processed products may have stricter cancellation conditions.

Once an order has shipped, it generally cannot be cancelled, although an eligible return may be available under the applicable return terms.

There is no single universal cancellation fee that applies to all Between Living products. Where a manufacturer-specific or product-specific cancellation fee applies, that applicable fee governs.

Please review our Cancellation Policy for complete information.

11. Returns and Refunds

Returns and refunds are governed by our Return & Refund Policy together with applicable product-specific and manufacturer-specific terms.

Return eligibility may vary according to the product and manufacturer.

Conditions may include:

  • A stated return period
  • Product condition requirements
  • Original packaging requirements
  • Return authorization
  • Customer-responsible return shipping
  • Freight charges
  • Restocking fees
  • Manufacturer inspection
  • Other product-specific requirements

Eligible customer-initiated returns may be subject to an applicable restocking fee and applicable return shipping or freight costs.

There is no universal restocking percentage applicable to every product sold by Between Living.

Where specific product or manufacturer return terms apply, those terms govern the relevant product.

12. Manufacturer Warranties

Products may include warranties provided by their respective manufacturers.

Warranty duration, coverage, exclusions, procedures, remedies, registration requirements, and other conditions vary by product and manufacturer.

Between Living may assist customers with manufacturer warranty matters where appropriate, but unless expressly stated otherwise, Between Living does not independently expand or alter a manufacturer’s warranty.

Warranty claims may involve:

  • Manufacturer review
  • Documentation
  • Photographs
  • Serial numbers
  • Proof of purchase
  • Troubleshooting
  • Replacement components
  • Repair
  • Other remedies determined under the applicable warranty

Nothing in these Terms limits any warranty or consumer right that cannot lawfully be excluded.

13. Installation and Product Use

Certain products may require professional electrical, plumbing, structural, mechanical, ventilation, drainage, site-preparation, permitting, or installation services.

Customers are responsible for confirming applicable site conditions and professional requirements.

Unless expressly contracted otherwise, Between Living is not acting as the customer’s:

  • Electrician
  • Plumber
  • Engineer
  • Architect
  • General contractor
  • Code official
  • Healthcare professional

Customers should follow manufacturer installation, operation, maintenance, and safety instructions.

Where licensed professionals are required by law, code, manufacturer instructions, or the nature of the work, customers are responsible for obtaining appropriately qualified professionals.

Our Disclaimer Policy contains additional information regarding technical, installation, and wellness guidance.

14. Wellness and Health Information

Certain products sold through Between Living relate to heat exposure, steam, hydrotherapy, cold exposure, recovery, relaxation, and other wellness practices.

Information available through the Website is provided for general informational and product-related purposes and is not medical advice.

Between Living does not diagnose, treat, cure, or prevent medical conditions and does not provide individualized healthcare recommendations.

Customers should consult an appropriately qualified healthcare professional where medical conditions, medication use, pregnancy, cardiovascular concerns, mobility limitations, sensitivity to temperature, or other health considerations may affect use of a product.

15.1 Between Living Content

The Website may contain content owned by or licensed to Between Living, including:

  • Original photography
  • Custom design elements

  • Videos
  • Warranty materials
  • Product documentation
  • Other third-party materials

Such materials may remain the property of their respective rights holders and may be displayed pursuant to supplier relationships, authorization, licenses, legal rights, or other lawful bases.

15.3 Limited Use

Subject to these Terms, Between Living grants users a limited, revocable, non-exclusive, non-transferable right to access the Website for lawful personal or internal business purchasing purposes.

You may not, without applicable permission:

  • Reproduce protected Website content for commercial exploitation
  • Sell or sublicense Website content
  • Misrepresent Between Living content as your own
  • Use Between Living branding in a manner that implies unauthorized affiliation
  • Circumvent technological protections
  • Systematically scrape or extract protected Website content in violation of applicable law

Nothing in these Terms transfers ownership of Between Living intellectual property to you.

16. User Content, Reviews and Submissions

16.1 Content You Submit

If you voluntarily submit a review, testimonial, photograph, feedback, comment, suggestion, or other content to Between Living, you represent that you have the necessary rights to provide that content.

You retain ownership rights you may have in your original content.

By submitting content for publication or promotional use, you grant Between Living a non-exclusive, worldwide, royalty-free license to use, reproduce, display, adapt, format, and distribute that content in connection with our Website, marketing, customer communications, and business operations, subject to applicable law and any agreed limitations.

16.2 Prohibited Submissions

You may not knowingly submit content that:

  • Is unlawful
  • Is defamatory or threatening
  • Infringes intellectual-property rights
  • Violates another person’s privacy
  • Is fraudulent or intentionally misleading
  • Contains malicious code
  • Is submitted without necessary permission

16.3 Moderation

Between Living may remove or decline to publish user content where reasonably necessary for legal, security, relevance, integrity, or Website-management purposes.

17. Prohibited Activities

You agree not to use the Services to:

  • Violate applicable law
  • Commit or facilitate fraud
  • Submit knowingly false transaction information
  • Interfere with Website security
  • Circumvent access controls
  • Attempt unauthorized access to accounts, systems, or data
  • Introduce malware or malicious code
  • Impersonate another individual or entity
  • Infringe intellectual-property or privacy rights
  • Use automated systems in a manner that materially disrupts the Website
  • Exploit Website errors or vulnerabilities
  • Engage in activity that materially interferes with other customers’ use of the Services

18. Third-Party Services and Links

The Website may contain links to manufacturers, service providers, payment services, installers, informational resources, social-media platforms, or other third parties.

Third-party services operate under their own terms and privacy practices.

Between Living is not responsible for the independent conduct, content, availability, or policies of third parties merely because a link appears on the Website.

Where Between Living separately undertakes responsibility for a specific third-party-arranged service, that responsibility will be determined by the applicable agreement or terms.

19. Website Disclaimers and Warranties

19.1 Website Availability

To the extent permitted by law, the Website and general informational content are provided on an “AS IS” and “AS AVAILABLE” basis.

Between Living does not guarantee that Website access will always be:

  • Uninterrupted
  • Error-free
  • Free from temporary technical problems
  • Available on every device or browser

19.2 Product Warranties

Nothing in the preceding Website disclaimer eliminates an applicable manufacturer warranty, express Between Living obligation, statutory warranty, or consumer right that cannot lawfully be excluded.

Manufacturer warranties are governed by their applicable terms.

19.3 Informational Reliance

General information on the Website does not substitute for professional advice, manufacturer instructions, or site-specific evaluation where those are reasonably required.

Please review our Disclaimer Policy for additional information.

20. Limitation of Liability

To the maximum extent permitted by applicable law, Between Living and its owners, officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the Website or a transaction, except where such liability cannot lawfully be excluded or limited.

Without limiting rights that cannot lawfully be restricted, Between Living is not responsible for losses caused solely by circumstances outside its reasonable control, including independent failures or delays attributable to:

  • Third-party internet services
  • Customer devices
  • Customer-provided information
  • Independent contractors
  • Financial institutions
  • Carriers
  • Manufacturer systems
  • Other third parties

where Between Living has not independently caused or assumed responsibility for the loss.

Nothing in these Terms excludes or limits liability for matters that cannot lawfully be excluded or limited.

Nothing in this section overrides an express obligation undertaken elsewhere in these Terms, another Between Living policy, or applicable product-specific terms.

21. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Between Living and its owners, officers, employees, contractors, and affiliates from third-party claims, liabilities, losses, damages, and reasonable expenses arising directly from:

  • Your unlawful use of the Services
  • Your material violation of these Terms
  • Your infringement of another person’s intellectual-property or privacy rights
  • Content you knowingly submit without necessary rights or authorization
  • Fraudulent or intentionally wrongful conduct by you

This obligation does not require you to indemnify Between Living for liability caused by Between Living’s own conduct where such indemnification is prohibited by applicable law.

22. Suspension and Termination

Between Living may restrict or suspend access to Website functionality where reasonably necessary because of:

  • Material violation of these Terms
  • Fraud or suspected fraudulent activity
  • Security threats
  • Abuse of Website systems
  • Unlawful activity
  • Unauthorized access
  • Other legitimate Website-protection concerns

Where appropriate, termination or suspension of Website access does not automatically eliminate rights or obligations associated with orders already placed.

Existing payment, fulfillment, return, warranty, and legal obligations will continue as applicable.

23. Force Majeure and Events Outside Reasonable Control

To the extent permitted by applicable law, Between Living will not be responsible for delay or failure caused by events outside our reasonable control.

Examples may include:

  • Severe weather
  • Natural disasters
  • Fires
  • Floods
  • Transportation disruptions
  • Carrier interruptions
  • Labor disruptions
  • Government actions
  • Supply-chain interruptions
  • Manufacturer shutdowns
  • Utility or communications outages
  • Acts of war or terrorism
  • Public emergencies
  • Other events beyond reasonable control

Where such an event affects an order, Between Living will make reasonable efforts to communicate material information available to us and work toward an appropriate resolution.

Nothing in this section eliminates rights that cannot lawfully be excluded.

24. Governing Law

To the extent permitted by applicable law, these Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles.

Subject to applicable law, disputes concerning these Terms may be brought in an appropriate state or federal court located in Delaware unless another forum or process is required by law.

Nothing in this section deprives a consumer of protections or rights that cannot lawfully be waived or restricted.

25. Changes to These Terms

Between Living may update these Terms periodically to reflect changes in:

  • Our Website
  • Products
  • Services
  • Business practices
  • Policies
  • Technology
  • Legal requirements

Changes become effective when published on the Website unless otherwise required by applicable law.

The Last Updated date at the top of these Terms identifies the most recent revision.

Revised Terms generally apply prospectively to subsequent Website use and transactions.

A later revision does not retroactively rewrite material terms governing a completed transaction except where required by law or expressly agreed.

26. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted where possible, and the remaining provisions will continue in effect.

27. No Waiver

If Between Living does not immediately enforce a provision of these Terms, that does not automatically waive our right to enforce that provision or another provision later.

A waiver is effective only to the extent expressly provided.

28. Assignment

You may not assign or transfer contractual rights or obligations arising under these Terms without prior written consent where such consent is legally permitted to be required.

Between Living may assign or transfer its rights and obligations in connection with a merger, acquisition, restructuring, sale of business assets, or similar transaction, subject to applicable law.

29. Entire Agreement and Policy Relationship

These Terms, together with the policies and specific terms applicable to your transaction, constitute the agreement governing your use of the Services and purchase from Between Living.

These may include our:

  • Billing Terms & Conditions
  • Shipping Policy
  • Return & Refund Policy
  • Cancellation Policy
  • Privacy Policy
  • Cookie Policy
  • Disclaimer Policy
  • Product-specific terms
  • Manufacturer-specific terms
  • Applicable warranty documentation

Where a policy or product-specific term addresses a subject more specifically than these general Terms, the more specific provision governs that particular subject to the extent of any conflict.

Nothing in this section allows a Website policy to override rights that cannot lawfully be restricted.

30. Electronic Communications

By placing an order or communicating with Between Living electronically, you agree that order confirmations, receipts, shipping communications, policy communications, and other transaction-related notices may be provided electronically where permitted by law.

It is your responsibility to provide an accurate email address and contact information.

Marketing communications are governed separately by applicable consent requirements and privacy law.
